The protection of personal data is a great concern of our company. We would like you to know when and what data we save and how we use them. When we edit and process personal data we observe the requirements of the EU General Data Protection Regulations (GDPR) and the new Federal Data Protection Act (BDSG).

This statement shows you the aspects of our offer which are related to data protection. Moreover, with respect to some processing procedures you declare to us that you consent to our collection, processing and use of your personal data as well as forwarding them to third parties only for the purposes mentioned in Clause 2 (b) under specific requirements and in a certain scope.

Of course, you can revoke your consent at any time. You can send the revocation in writing to Solarwatt GmbH, Maria-Reiche-Straße 2a, 01109 Dresden (hereinafter “Solarwatt”). However, it is sufficient to send an e-mail to our customer service at info@solarwatt.com. In the case you revoke your consent, we must ask you to understand that we cannot provide specific services at all, cannot provide them fully or cannot provide them without disruption.

1. Collection and processing of personal data

First, the collection of your personal data helps us to provide you or have a cooperation partner provide you with the services and advice which you require.

a) Visit on the website

In principle, you can view our website without providing personal data. As a standard, we save only the website which you have been redirected from to our website, the name of your internet service provider, which of our websites you have visited and the date and duration of your visit. For this purpose, small files (the so-called cookies) are inserted in the cache of your PC for the duration of your visit. We are talking about the-so-called temporary session cookies (cf. the information about the permanent cookies in Clause 6 below). The relevant data are thereby saved on the server of our service provider webit! Gesellschaft für neue Medien mbH, Schandauer Straße 34, 01309 Dresden. The session cookies are automatically deleted, as soon as you close your browser window. With the help of session cookies, we create the so-called session ID for internal statistical purposes. The data acquired are fully anonymized. However, your IP address and time stamp are saved for security purposes and used only for internal purposes. The IP address is a PC-related identification which provides a message about the PC used to access internet or internet gateway used and at the time of the online visit. The term ‘time stamp’ describes a value in a defined format which allocates time to a result (for example, the result of the sending or receiving a message, modifying data, among other things). The purpose of this time stamp is to make it clear to people or PCs when certain results occurred.

Our websites can include links to the websites of other providers which are not associated with us. When you click the link, we don’t have any influence on the processing of personal data (such as IP address, URL where the link is available) which have been forwarded to third parties by clicking any links. The conduct of third parties is outside our control. We cannot accept any liability for the processing of such personal data by third parties.

b) Choice of service

Your personal data are collected and processed, only if you are interested in a specific advice about our products or offer and you have provided the data for this purpose. The scope of collecting and processing data depends on the relevant product and the service you require (cf. Clause 2 through 4 for more detail).

c) Cancellation of e-mail subscription

If we send you messages by e-mail (newsletter, product information, among other things), you can cancel at any time your subscription for such e-mails in the future. If you use the cancellation possibility that we offer, no costs will arise apart from the transmission costs according to the basic tariffs. For this purpose, you can simply click the link included in every e-mail and unsubscribe from the e-mail service or send a message to info@solarwatt.com. If you send us this message to stop receiving e-mails in the future, no more messages will be sent to the e-mail address you provided. This shall not include the e-mails which we send to perform any contract we concluded with you (for example, the comparable offers you requested).

2. Advice or offer regarding SOLARWATT products or components for energy generation, energy storage or energy management

a) Data to be collected

In the above-mentioned cases SOLARWATT collects the following data:

  • your gender,
  • your full and correct name,
  • your e-mail address,
  • your full and correct postal address,
  • your phone number,
  • your interest in products
  • if applicable, a message sent to us,
  • if necessary, other data related to products.

b) Use of data

SOLARWATT provides these data directly to a suitable external trade partner which is particularly appropriate for the product requested or information required in the opinion of SOLARWATT or to a cooperation company which selects the appropriate trade partner on behalf of SOLARWATT. It cannot be predicted before or upon your query which trade partner will have your data forwarded. However, you can be sure that your data are forwarded to persons who have the relevant specialist knowledge and as a rule, work within your location.

The trade partner or partners will contact you and will then send you your individual information.

3. Access to trade partner area

We offer a log-in protected area on our website (“professionals area)” for certified installers who want to commercially distribute our products to end clients. To create access, we save and process your personal data and your commercial data. If necessary, we forward these data to external partners for the purpose of providing services.

4. Rights of data subjects to information, correction and deletion of data, restriction and revocation of data processing

Requirements for editing and processing of personal data according to Art. 13 of the GDPR

Purpose

Our company edits and processes personal data for the purpose of starting and maintaining order-related business relationships. All data categories are affected for the purpose of performing the pre-contractual and contractual obligations.

Transfer of data to third parties

Data are transferred to third parties, only if it is necessary for achieving the business purpose. Personal data are not transferred to third parties or are transferred only if there is a consent of the data subject, third parties can also be located in third countries with unclear data protection level (as a rule, the countries outside the EU) which are not involved with the business purpose.

Lawfulness of data processing

The personal data are collected, processed and used within the framework of what is permitted by law according to Art. 5,6 and 9 of the GDPR. If personal data are collected from the data subject, the latter is entitled to transparent information according to Art 13 of the GDPR. In principle, only such information is processed and used which is necessary for operational performance and is directly related to the purpose of processing. Hereby, special requirements for collection, processing and use of specific categories of personal data are fulfilled according to Art. 9 of the GDPR and Section 22 of the BDSG. According to the GDPR the editing and processing of sensitive data is permitted only based on the authorization right or when a legal basis is submitted.

Rights of data subjects

According to Art. 15 and the following articles of the GDPR the data subjects have the right to information, correction and deletion of data as well as restriction of and revocation of editing and processing of their data.

The right of data subjects to revocation

According to Art. 13 (2)(c) of the GDPR the data subjects have the right to revoke the consent for editing and processing personal data in the future, if the processing is based on Art. 6 (1)(a) or Art. 9 (2)(a) of the GDPR. The lawfulness of processing which had been performed based on the consent until it was revoked shall not be affected by the above.

However, a revocation and failure to make the required data available will normally frustrate the purpose for which the data have been collected or must be collected. The written form is required to exercise your rights. For this purpose, please, contact us by e-mail at info@solarwatt.com.

Deletion of personal data

Personal data are deleted, if the purpose of saving no longer exists and no legal standard (e.g., regarding the statutory retention period) prescribes the preservation of data. The requirements of Art. 17 of the GDPR in conjunction with Section 35 of the BDSG shall apply. If deletion is not possible due to legal, contractual, commercial or fiscal reasons, the processing of data can be restricted upon the request of the data subject. The written form is required to exercise your right.

The right of data subjects to data transferability

The company ensures the right to data transferability according to Art. 20 of the GDPR. Each data subject has the right to receive a copy of his/her personal data in a usual machine-readable file format.

5. Cookies

The websites partly use the so-called cookies. Cookies do not cause any damage to your PC and do not contain any viruses. Cookies are used to make our offer more user-friendly, effective and secure. Cookies are small text files which are placed on your PC and saved by your browser. Most of the cookies we use are the so-called “session cookies”. They are automatically deleted at the end of your visit. Other cookies remain saved on your terminal device until you delete them. These cookies help us to recognize your browser when you visit our website again.

You can adjust the settings of you browser, so that you would be notified when cookies are placed and would allow cookies only in an individual case, exclude the acceptance of cookies in specific cases or in general, as well as activate automatic deletion of cookies when the browser is closed. The cookies which are required to perform electronic communications procedures or provide specific functions you need (e.g., login function) are saved on the basis of Art. 6 (1)(f) of GDPR. As a website operator, we have a justified interest in saving cookies to achieve a technically flawless and optimized provision of services. If other cookies (e.g., cookies for the analysis of your surfing habits) are saved, they are discussed separately in this data protection statement.

Thereby, relevant data are saved on the server of our service provider (see, Clause 1 (a) above).

Server log files

The website provider automatically collects and saves information in the so-called server log files which your browser automatically transfers to us. This includes:

  • browser type and browser version,
  • operating system used,
  • referrer URL,
  • host name of the accessing computer,
  • time of the server request,
  • IP address.

These data are not combined with other data sources.

6. Google Analytics

We use cookies to provide the services to our visitors, improve the website search for our clients, better understand our visitors or be able to determine the settings of our visitors (country, language, etc.). Moreover, we use cookies to obtain total data about website traffic and interaction and determine the trends and statistics. Thus, we can provide a better website experience and better tools in the future. For this purpose, we use the Google Analytics service.

Cookies are parts of information which are sent to your PC through our website when you stay on the website. They work in combination with the content of the website itself to collect and save information. For example, they are used for saving and processing the session identification of the website.

You can adjust the settings of your PC, so that you would be notified every time when the cookie is sent or you would deactivate them. You can adjust these settings in your browser. There are slight differences between individual browsers, so you should check the help menu of your browser how to correctly adjust the cookie settings. If you deactivate cookies, it is possible that you will no longer have access to some functions which make the website more efficient and some of our services will no longer function correctly.

Moreover, by downloading and installing the plug-in available at the following link (http://tools.google.com/dlpage/gaoptout?hl=de), you can prevent Google from collecting the data generated by cookies regarding your use of the website (including, your IP address) and from processing of these data.

On this website Google Analytics was extended with “gat._anonymizeIp();” code to guarantee anonymized collection of IP addresses (the so-called IP masking).

7. Facebook Custom Audiences

Our website uses online retargeting technologies, such as the pixel of Facebook Ireland Limited. These technologies help us to reach every user (who has already showed interest in the products on our website) with tailor-made online advertisement on Facebook advertising network. We have learned from the studies on that subject that blending personalized, interest-related advertisement is more interesting for the internet user than the advertisement which has none of such personal references. Advertising materials are blended by retargeting based on the analysis of the previous user behavior. Of course, no personal data are saved or only pseudonymized data are saved and likewise, the retargeting technologies are used in compliance with the applicable legal data protection regulations.

For this purpose, a Facebook cookie is stored on your PC. Please refer to the data protection (privacy settings) provisions of Facebook for information about the purpose and scope of data collection as well as the further processing and use of data by Facebook and your options for privacy settings at  https://www.facebook.com/policy.php  and https://www.facebook.com/ads/settings.

By deleting this particular cookie from your browser or by using the function “delete all cookies”, you can deactivate the collection of data for the purpose of personalized advertisement. You can revoke the objection at any time.   You can opt-out of remarketing by visiting  https://www.facebook.com/ads/preferences.

8. Security

We introduce technical and organizational security measures to guarantee that your personal data are protected against loss, incorrect changes or unauthorized access by third parties. In any case, only authorized persons from our side have access to your personal data and only to the extent which is necessary within the framework of the above-mentioned purposes. The security measures are continuously adjusted in line with the improved technical possibilities.

Our homepage contains links to other websites. It is outside our control whether their operators comply with data protection regulations. Please, take note of the exclusion of liability.

10. Data protection officer

By using our website, you consent to the use of data described above. The consent can be revoked at any time with future effect.
